LOVEJOY, Georgia - A man with a shellfish allergy is dead after eating an entree with crab at a restaurant. An autopsy Monday confirmed that 35-year-old Rodney Hawkins went into anaphylactic shock and died after eating the dish at a Ruby Tuesday restaurant in Lovejoy last week. Georgia Bureau of Investigation spokesman John Bankhead said Hawkins had ordered a chicken dish that contained no shellfish but was served another chicken dish that contained crab. More... Probably will get sued. I don't know about this one. For a while I ran a restaurant. It never ceases to amaze me that people will walk into a restaurant which is known to produce large quantities of what they are deathly allergic to, and then order. It's like being hired to detassel and have a serious allergy to corn pollen. I'm not a skiddish person, and admittedly, had I a food allergy, I too would likely be "a corn detasseler". =) But it still doesn't take away the fact that it is also the consumers responsibility to be aware of what they are eating. Especially if the said person is severely allergic to something prepared at the restaurant. The article didn't really state. I assume because most people don't, but did he announce his food allergy? If not how's the business going to know? Granted, he was served the wrong meal, but that happens. It's NORMALLY something that DOESN'T result in someones DEATH. However, had they known, they could have paid special attention to this persons order, and a mistake would have likely not been made. When I ran my restaurant, I tried to interact with the customer like this. You post warning signs, and when your customers inform you of there allergies, you take the safe road. I've told many people that it would be best that they not eat at my establishment because of an allergy.

Sounds weird if he really did order Chicken Oscar.Seems a break down of communication is the problem.Maybe he didn't say "this will kill me if I eat it!" Definate lawsuit and a no tip situation...

The man that died did not state that he was allergic to seafood and he and his wife were going over the option of chicken fresco and chicken oscar. If your allergic to seafood why would that be in your options. He comes in the restaurant often and he usually gets the grand sampler or the chicken fresco so when the oscar came out to his table he should have realized it was the wrong dish. The chicken oscar has big peices of crab meat on top and the fresco has only tomatoes so if you get it all the time he should know.

Someone was right when they said that a consumer should announce an allergy that severe. I'm sure it was just as devistating to the server as it was to the wife, but I think the server's intentions, despite the mistake, were well. Neither she nor the company should be penalized. That man's death was in God's will, not Ruby Tuesday's.

I am a manager for Ruby Tuesday, and I can see where BY NAME these entrees could be easily confused. Whether the guest ordered wrong or the server wrote the wrong order down, once served, it would have been obvious as to what he was eating. The smell alone SCREAMS crab meat..not to mention the look of the dish. These are HUGE lumps of crab meat we are talking about...and if by chance I couldn't tell just by looking at it, If I had an allergy, I would want to know what the very large lump of whatever was on top of my chicken....
